AI Photoshoot Services

By purchasing any AI Photoshoot package, you agree to the following Terms of Service.
1. Scope of Service
The AI Photoshoot is a custom creative service using artificial intelligence tools combined with artistic direction and professional judgment to generate visual assets based on client-provided materials.
The service includes:
- Creative direction and AI-based image generation
- Visual refinement based on feedback
- Delivery of final image assets according to the selected package
The service does not include:
- Traditional photography
- Guaranteed exact likeness
- Unlimited revisions or open-ended work
2. Client Responsibilities & Required Inputs
The quality of the final result depends directly on the quality and clarity of the client’s input.
By purchasing this service, the client agrees to provide:
- 20–50 reference images of themselves
- Images may be professional photos or phone selfies
- Images should reflect typical appearance, makeup, and clothing
- Images must be delivered via external downloadable links (e.g. Google Drive, iCloud, Dropbox)
Clients acknowledge that:
- Image files are not uploaded into Notion
- Links must remain accessible until project completion
- The service provider selects the final images used for processing
3. Input Window & Delivery Logic
3.1 Input Window (All Packages)
Clients have 14 days after purchase to submit:
- The required intake information
- Image download links
Minor delays beyond this window are acceptable; however, delivery timelines are not paused or reset by delayed input.
3.2 Delivery Timelines by Package
MINI Package
- 2 visual styles
- Optional archetype strategy session
- No priority or flex delivery
- Once all required inputs are received, delivery occurs within 4 weeks
STANDARD Package
- 4–6 distinct visual styles
- Optional archetype strategy session
- Flex delivery period: 2 months
- Flex delivery starts after the 14-day input window ends
PREMIUM Package
- Extended scope and refinement
- Optional archetype strategy session
- Flex delivery period: 4 months
- Flex delivery starts after the 14-day input window ends
Delays in client feedback or communication do not extend delivery windows.
4. Strategy & Alignment Sessions
- Mini, Standard and Premium packages include the option to schedule a strategy or alignment session.
- Participation is optional; feedback is required.
- Feedback may be provided via call, voice message, or written communication.
5. Communication & Feedback Responsibility
This service requires active collaboration.
Clients agree to:
- Provide clear, actionable feedback
- Respond within reasonable timeframes
- Understand that vague or contradictory feedback may be interpreted professionally
Creative direction decisions remain at the discretion of the service provider.
6. Lack of Feedback, Inactivity & Project Completion Authority
If the client does not provide feedback or communication after a reasonable request, the service provider reserves the right to:
- Interpret silence as approval
- Proceed independently based on professional judgment
- Finalize and deliver assets without further revisions
If the client remains inactive for an extended period, the service provider may:
- Complete the project based on work delivered to date, or
- Conclude the project as fulfilled
In such cases:
- The service is considered completed
- No refunds are issued
- Unused scope may be forfeited
Projects are not held open indefinitely.
7. Intellectual Property & Usage Rights
7.1 Authorship
All generated images remain the intellectual property of the service provider (author rights retained).
7.2 Client License
Upon full payment, the client receives a non-exclusive, perpetual commercial license to use the delivered images for:
- Personal branding
- Marketing and advertising
- Websites and social media
Clients may not:
- Resell images as standalone assets
- Claim authorship
- Train AI models using the images
- Distribute images as templates or datasets
8. AI Tools & Commercial Rights
The service uses professional AI tools and workflows that support commercial usage rights.
The service provider:
- Confirms commercial usability of outputs
- Retains discretion over tool selection
- Is not required to disclose specific tools or workflows
Clients acknowledge that AI-generated images involve artistic interpretation and may not replicate physical appearance perfectly.
9. Data Protection & GDPR Compliance
The service provider acts as data controller under GDPR (EU Regulation 2016/679).
Client data is processed solely to deliver the service and may include:
- Image processing
- AI-based image generation
- Secure data storage
- Project management tools (e.g. Notion)
- Email communication systems
- Payment providers (payment data handled exclusively by third parties)
Data is not sold or shared beyond what is necessary to deliver the service.
Clients have all rights granted under GDPR, including access, correction, deletion (where legally applicable), and objection to processing.
By purchasing this service, the client explicitly consents to the processing of their personal data and images for AI-based image generation.
10. Refunds & Cancellations
Due to the custom and digital nature of this service:
- All sales are final
- No refunds are issued once work has started
Client inactivity, delayed feedback, or delayed input does not entitle the client to refunds or extensions.
11. Limitation of Liability
The service provider is not liable for:
- Subjective dissatisfaction with aesthetic outcomes
- Platform or algorithm changes affecting image usage
- Client misuse of delivered assets
12. Governing Law & Jurisdiction
These Terms of Service are governed by the laws of the Czech Republic.
All disputes fall under the exclusive jurisdiction of the courts of the Czech Republic.
